1. Acceptance of Terms

By accessing our website or engaging our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our website or services. These Terms constitute a legally binding agreement between you ("Client") and Jai Dev Traders ("Service Provider").

2. Services Offered

Jai Dev Traders provides the following professional services:

• Graphic Design: Logo design, brand identity, social media graphics, poster/flyer design, business card design, packaging design, and related visual communication services.
• Social Media Management: Profile setup, content creation, post scheduling, engagement management, analytics reporting, and digital marketing strategy.

The exact scope, deliverables, and timeline for each project will be agreed upon in writing before work commences.

3. Payment Terms

• All prices are listed in Indian Rupees (INR) unless otherwise stated.
• Advance Payment: A minimum of 50% advance payment is required before project commencement. The remaining balance is due upon completion, before delivery of final files.
• Accepted Payment Methods: PayPal, Bank Transfer (NEFT/RTGS/IMPS), and UPI.
• PayPal Payments: When paying via PayPal, the transaction is governed by PayPal's User Agreement and Buyer Protection policies.
• Invoices are generated with applicable GST as per Indian tax laws.
• Late payments may result in project delays or suspension of services.

4. Project Process

• Briefing: Client provides a detailed project brief including requirements, preferences, references, and any brand guidelines.
• Concept Development: We create initial concepts based on the agreed brief.
• Revisions: Revisions are included as per the selected package. Additional revisions beyond the package limit may incur extra charges.
• Approval & Delivery: Final files are delivered after client approval and receipt of full payment.

5. Intellectual Property Rights

• Upon receipt of full payment, the client receives full ownership and rights to the final approved deliverables.
• Jai Dev Traders retains the right to showcase completed work in our portfolio unless otherwise agreed in writing.
• Preliminary concepts, drafts, and rejected designs remain the property of Jai Dev Traders.
• The client is responsible for ensuring that any materials (text, images, logos) provided to us do not infringe on third-party intellectual property rights.

6. Client Responsibilities

• Provide accurate and complete project requirements.
• Supply necessary materials (logos, brand guidelines, content) in a timely manner.
• Respond to communications and provide feedback within reasonable timeframes.
• Ensure all content provided is legally owned or licensed for use.
• Delays caused by late client responses may affect project timelines.

7. Limitation of Liability

Jai Dev Traders shall not be liable for:

• Any indirect, incidental, or consequential damages arising from the use of our services or deliverables.
• Loss of business, revenue, or profits related to the use or inability to use our designs or services.
• Any claims arising from the client's use of deliverables in a manner not agreed upon.

Our total liability is limited to the amount paid by the client for the specific service in question.

8. Confidentiality

Both parties agree to maintain confidentiality regarding proprietary information, business strategies, and project details shared during the engagement. This obligation continues after the termination of services.

9. Termination

Either party may terminate the engagement by providing written notice via email. Upon termination:

• Payment for work completed up to the termination date is due immediately.
• Refund terms as outlined in our Refund & Cancellation Policy apply.
• All client-provided materials will be returned or deleted upon request.

10. Dispute Resolution

In the event of a dispute:

• Both parties shall first attempt to resolve the matter amicably through direct communication.
• If unresolved, the dispute shall be subject to mediation in New Delhi, India.
• For PayPal transactions, disputes may also be raised through PayPal's Resolution Center.

11. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of India. Any legal proceedings shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. Updated terms will be posted on this page with a revised effective date. Continued use of our services after changes constitutes acceptance of the new terms.
